Concerning: The claim concerns the failure of the Crown to provide for the healthcare of Māori in respect of gambling. The claimant alleges that the Crown has breached the principles of the Treaty of Waitangi by failing to: • Regulate the Gambling Act 2003, Local Government Act 2002, Racing Act 2003 and treatment related to harmful gambling; • Engage with Māori in the development of the Gambling Act 2003; • Identify and fully inform Māori of the social impact of Class 4 gambling; • Ensure local councils are appropriately engaging with Māori when reviewing the gambling policies; • Support Māori affected by family violence which has been caused by harmful gambling; • Ensure community funding is distributed in a manner that is fair and equitable to Māori; and • Ensure that gambling harm minimisation is not at the expense of hauora, wairua, tinana and hinengaro of Māori or any person using Class 4 Gambling Machines.
