Concerning:The claim concerns the failure of the Crown to provide for the healthcare of Māori in respect of their susceptibility to disease, and disproportionate loss of life and loss of good health. The claimant alleges that the Crown has breached the principles of the Treaty of Waitangi by failing to: • Provide health services necessary to stem the disproportionate loss of life and loss of good health amongst Māori; • Provide accessible services for good health; • Recognise Māori have difficulties in accessing doctors or specialists services; • Address the high cost of transport and consultation fees; • Address the unclear or misunderstood medical information provided to Māori in relation to serious illness; and • Provide equal funding to Māori health service providers.

The claimant alleges that the Crown has breached the principles of the Treaty of Waitangi by failing to: • Provide a health clinic or even health services to the marae Papakainga at Maungarongo Marae; • Allow development of Poroti Springs for its healing properties, by separating the springs from the Marae and running a main state road through the middle of the land, and right over the head waters of Poroti Springs; and • Prevent storm water and logging truck runoff from the roadway polluting the headwaters of Poroti Springs.
