Wai No: 2677 Claim: the Aotea Overlapping Claims Process Claim Date Received: 11 Oct 17 Claimant: Huhana Lyndon and George Davies, Puawai Walker and Mylie George, Carmen Hetaraka, Tony Palmer Representing: Ngati Rehua, Ngatiwai and Ngapuhi whanau Concerning: concerns the Crown’s overlapping claims settlement process in Aotea and Te Raki. The claimants allege that the Crown has breached the principles of the Treaty of Waitangi by: • Intending to provide redress to Ngāti Maru, Ngāti Tamatēra and Te Patukirikiri and other Hauraki iwi which extends into the heartland of Ngāti Rehua and Ngātiwai; • Implementing a flawed settlement process with failure to adapt to the Te Raki context; • Attempting to provide redress in a manner that is destructive to relationships between iwi; • Failing to conduct a robust process to gain sufficient knowledge of Aotea interests or ensure sufficient provision of redress; • Offering redress on Aotea to the Hauraki iwi, without an adequate understanding of Ngāti Rehua and Ngātiwai ki Aotea interests or provisions of redress for their interests; • Failing to conduct a robust process to gain sufficient knowledge of Aotea interests or ensure sufficient provision of redress; • Conducting mandating processes in Te Raki which have caused significant damage to whanaungatanga; • Failing to conduct a robust process for proposed redress on Aotea; • Failing to inform those who live on Aotea and Ngātiwai ki Aotea what was being negotiated; • Failing to carry out a fair assessment of Hauraki’s historical claim interests in Aotea; and • Failing to engage with hapū of Ngātiwai who were disputing the Ngātiwai Trust Board mandate.
