In response to the New Zealand Fuel Response Plan 2026, the Tribunal's Chairperson Chief Judge Dr Caren Fox has developed a protocol to ensure the Tribunal can continue to operate while the Fuel Response Plan is in effect.
The Waitangi Tribunal Fuel protocol takes effect immediately and will remain in place for the duration of the New Zealand Fuel Response Plan.
The protocol sets out how Tribunal hearings will be managed across the different phases of the Fuel Response Plan, with an increased emphasis on remote participation where appropriate. Judicial discretion under existing legislation and principles continue to apply.
