Concerning: The claim concerns the area of land bounded by Takou Bay to the north, Puketona Junction to the South, and inland to State Highway 10, the area also includes the Waitangi River. Firstly, the claimants claim that they have been prejudicially affected by the failure of Crown land agents to conduct land transactions in a fair and equal manner, consistent with Lord Normanby’s instructions. The claimants claim that as a consequence of the unfair land transactions, Maori were rendered virtually landless, and further, that where they retained land, they were denied their right to exercise tino rangatiratanga over their lands, forests, and, resources. The claimants also claim that they have been prejudicially affected by the actions of Crown agents, specifically Maori Land Boards, and, the Native Land Court, in continuing the facilitation of the alienation of Maori land, and in particular, the failure to provide adequate reserves. The claimants claim that where reserves were set aside, the Crown failed to administer the reserves in a manner that protected them from alienation and encroachment. The claimants claim that all these matters are contrary to the principles of the Treaty of Waitangi.
